Terms of Service

1. Acceptance of Terms

By accessing or using SkillStamp (“the Platform”) at skillstamp.io, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

These Terms constitute a binding agreement between you and SkillStamp. We reserve the right to modify these Terms at any time. Material changes will be communicated via email. Continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old to use SkillStamp. By creating an account, you confirm that you meet this requirement and that all information you provide is accurate and truthful.

3. Account Registration

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at support@skillstamp.io if you suspect unauthorised access.
• You may not create accounts for others or operate multiple accounts for the same individual.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Platform Description

SkillStamp is an AI skills verification and hiring platform that enables:

• Candidates to build verified AI skills portfolios by completing assessments and projects.
• Employers to discover verified AI talent, send interview invitations, and run AI-generated live assessments.

Assessment scores, readiness ratings, and certifications displayed on the Platform are generated by AI models and algorithmic evaluation. They are provided as guidance only and do not constitute professional qualifications or guarantees of employment suitability.

5. Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent information on your profile or in assessments.
• Use another person's identity or credentials.
• Attempt to manipulate or game assessment scores through dishonest means.
• Scrape, harvest, or collect data from the Platform without our written consent.
• Use the Platform to send unsolicited commercial communications (spam).
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
• Upload malicious code, viruses, or any software designed to damage or interfere with the Platform.
• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Harass, discriminate against, or harm other users.

6. Intellectual Property

All content, design, code, trademarks, and materials on the Platform (excluding user-submitted content) are owned by or licensed to SkillStamp and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Your content: You retain ownership of content you submit (profile text, project submissions, etc.). By submitting content, you grant SkillStamp a non-exclusive, worldwide, royalty-free licence to display and use that content solely to operate and improve the Platform.

7. AI-Generated Content

The Platform uses artificial intelligence (including models provided by Anthropic) to generate assessment questions, scoring reports, and candidate insights. You acknowledge that:

• AI-generated content may contain errors or inaccuracies.
• Assessment results are not a substitute for professional judgement in hiring decisions.
• SkillStamp does not guarantee the accuracy or completeness of any AI-generated output.
• Employers are solely responsible for their hiring decisions.

8. Employer Responsibilities

Employers using the Platform agree to:

• Use candidate data solely for legitimate hiring evaluation purposes.
• Comply with all applicable employment, anti-discrimination, and data protection laws.
• Not share candidate profile data with unauthorised third parties.
• Treat all candidates fairly and without unlawful discrimination.

9. Limitation of Liability

To the fullest extent permitted by law, SkillStamp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of profits, data, or business opportunities.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £100.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

11. Termination

You may delete your account at any time via your account settings. We reserve the right to suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or for any other lawful reason.

Upon termination, your right to use the Platform ceases immediately. Sections 6, 9, 10, and 12 survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless consumer protection laws in your country require otherwise.

Before initiating legal proceedings, you agree to contact us at support@skillstamp.io to attempt to resolve the dispute informally.
